1. Acceptance of Terms
By accessing or using the Tavern Community website, web application, and mobile applications (collectively, the "Service"), operated by Tavern Community ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, applicants, and members.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.
4. Membership & Payments
Certain features require a paid membership subscription. Subscriptions are billed on a recurring basis (monthly, semi-annually, or annually) through Stripe or in-app purchase platforms. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with the applicable platform's refund policy.
5. Text Messaging (SMS/MMS) Program
Tavern Community operates a text messaging program (the "Messaging Program") to communicate with people who apply for membership and with members about their application and membership. By providing your mobile phone number and checking the SMS consent box on our membership application at taverncommunity.com/apply, you expressly consent to receive recurring automated text messages from Tavern Community at the number provided. These Terms govern the Messaging Program.
What messages you will receive
The Messaging Program sends application- and membership-status messages, including:
- Interview scheduling links after you apply;
- Interview reminders;
- Acceptance notifications, including a private link to register and complete membership;
- A welcome message after you join; and
- Related account and membership status updates.
How you opt in; consent is not a condition of purchase
You opt in by checking the consent checkbox next to the optional phone-number field on our membership application at taverncommunity.com/apply. The checkbox is never pre-selected, and we only send texts to people who actively check it. Your consent to receive text messages is not required to apply for membership, to purchase, or to use any part of the Service. You may also opt in by texting START to our number.
Message frequency & cost
Message frequency varies based on your interaction with us. Message and data rates may apply. Message and data rates are set by your wireless carrier and are your responsibility. If you have questions about your text or data plan, contact your wireless provider.
How to opt out (STOP) and get help (HELP)
You can cancel the Messaging Program at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. After you send STOP, we will send a single confirmation message and then stop sending texts; you will receive no further messages unless you opt in again. For help, reply HELP to any message, email info@taverncommunity.com, or call +1 973 303 9514. You can re-subscribe at any time by texting START.
Your privacy — we do not share or sell your information
We value your privacy. Mobile phone numbers, SMS opt-in, and consent are collected first-party by Tavern Community only and are never sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Information collected through the Messaging Program is handled in accordance with our Privacy Policy.
Carrier disclaimer & supported carriers
Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice and may include AT&T, T-Mobile, Verizon, and others. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed.
6. Acceptable Use
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Impersonate any person or entity, or falsely represent your affiliation.
- Harass, abuse, or harm other users.
- Upload or transmit viruses, malware, or other harmful content.
- Attempt to gain unauthorized access to any part of the Service or its systems.
- Scrape, data-mine, or collect information from the Service without authorization.
- Interfere with or disrupt the integrity or performance of the Service.
7. Venue Check-Ins
The check-in feature allows you to indicate your presence at participating venues. Check-in data may be visible to other members. You are responsible for checking out when you leave. We are not responsible for the accuracy of real-time occupancy data.
8. Events
Users may create, host, and attend events through the Service. Event hosts are responsible for the accuracy of event details and compliance with applicable laws. We do not guarantee event availability, quality, or outcomes. Paid event tickets are processed through Stripe; refund policies are set by event hosts unless otherwise stated.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Tavern Community and are protected by applicable intellectual property laws. You retain ownership of content you submit but grant us a non-exclusive, worldwide license to use, display, and distribute your content in connection with the Service.
10. Termination
We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Tavern Community shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
